The government is not done fighting the reinterpretation of the??Wire Act.
The??Department of Justice on??Friday formally filed an appeal in its legal battle with the??New Hampshire Lottery, beating the??Aug. 19??deadline by three times.
This appeal comes over two months following having a district court in New Hampshire issued a??60-page view .
Judge Paul Barbadoro, who oversaw the event, opined that the 2011 interpretation of the Wire Act revealed more accurate than the DOJ’s revised remark which came to light last year.
As a result, Barbadoro said, the Wire Act applies??only to sports gambling instead of to the broader range of gaming that the DOJ targeted.
In fact, the appeal has been expected. Barbadoro said as much through the April hearing:
It seems the road leads to the First Circuit Court of Appeals.
In a declaration, Jeff Ifrah, creator of the online gambling lobbying team iDEA Growth, known as the DOJ’s allure”barely unexpected” but”certainly unwarranted.”
It still has to officially request the court of appeals, Though its appeal filed. The court will assess the situation and then determine if moving forward with the situation is reasonable.
The First Circuit is not in session for both oral arguments but may return in??October.
At least the world of internet gambling will not change. However, is anybody’s guess.
The great news: It doesn’t, per se.
Over the last year, online gambling in the country has taken off, courtesy of a NJ sports betting industry that matches the two dozen NJ online casinos and gambling sites.
For the time being, operators at the Garden State can maintain business .
The good thing: We now return to some”what-if” point that was made after the emergence of the DOJ’s reinterpretation of the Wire Act.
Sports betting and online gaming in New Jersey have flourished. Operators have reported more than $31 million??in NJ casino revenue. The industry had had one month attaining that total before after the introduction of online sports betting since launch in November 2013.
To boot, sports gambling earnings in New Jersey has generated more than??$3.4 billion??in wagers since going live in June 2018, leading to roughly $221.7 million in earnings during that time.
While operators in the country might continue business as normal, clearly plenty is at stake should the First Circuit Court of Appeals reverse the ruling.
